Alluka LLC (“Alluka,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects visitors and clients to do the same. This DMCA Policy explains how we respond to claims of copyright infringement on https://allukallc.com (the “Website”) under the Digital Millennium Copyright Act, 17 U.S.C. § 512 (the “DMCA”).

In short: If you believe material on our Website infringes your copyright, send a written notice that includes the information listed in Section 3 to our designated agent. If your material was removed and you believe that was a mistake, you can send a counter-notification. Knowingly false claims can lead to liability for damages under 17 U.S.C. § 512(f).

1. Scope of This Policy

This Policy applies to content published on the Website, including pages, blog articles, images, graphics, videos, downloadable resources, and any material submitted by users, such as comments or testimonials. It covers claims of copyright infringement only. If your concern relates to trademarks, privacy, defamation, or another legal issue, please contact us using the details in Section 10 and describe the issue; it will be handled outside the DMCA process.

This Policy does not apply to content hosted on third-party platforms, such as social media networks or advertising platforms, even if Alluka created or manages that content for a client. Those platforms have their own copyright reporting procedures, and claims about content on them should be submitted directly to the platform.

2. Our Designated Agent

Notices of claimed infringement and counter-notifications should be sent to our designated agent for copyright matters:

Alluka LLC
Attn: DMCA Agent
8206 Louisiana Blvd NE
Albuquerque, New Mexico 87113, USA
Phone: +1 (575) 378-3891
Email: [email protected] (subject line: “DMCA Notice” or “DMCA Counter-Notice”)

Sending notices by email is the fastest way to reach us. Please send only copyright-related notices to this agent; other inquiries may not receive a response through this channel.

3. How to File a Notice of Infringement

Under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must be a written communication that includes substantially the following:

  1. Signature. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work. Identification of the copyrighted work claimed to have been infringed or, if multiple works are covered by a single notice, a representative list of those works.
  3. Identification of the infringing material. Identification of the material that is claimed to be infringing and that is to be removed or disabled, with information reasonably sufficient for us to locate it, such as the exact URL of each page where it appears.
  4. Contact information. Information reasonably sufficient to allow us to contact you, such as your name, mailing address, telephone number, and email address.
  5. Good-faith statement. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy and authority statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

A notice that does not substantially comply with these requirements may not be effective, and we may ask you for missing information before taking action. Before sending a notice, please consider whether the use could be a fair use or otherwise permitted by law, as courts have held that copyright owners should consider fair use before requesting removal.

4. What Happens After We Receive a Notice

When we receive a notice that substantially complies with the DMCA, we will act expeditiously to:

  • review the notice and, if appropriate, remove or disable access to the material identified;
  • take reasonable steps to notify the person who provided the material, where applicable, that it has been removed or disabled, and provide them with a copy of the notice; and
  • keep a record of the notice and our response.

If the material in question is content that Alluka created, we will review the claim in good faith and may remove, replace, or license the material as appropriate. We may share a copy of your notice, including your contact information, with the person who provided the material so they can respond.

5. How to File a Counter-Notification

If material you provided was removed or disabled and you believe this was the result of a mistake or misidentification, you may send a counter-notification to our designated agent. Under 17 U.S.C. § 512(g)(3), a counter-notification must be a written communication that includes substantially the following:

  1. your physical or electronic signature;
  2. identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled;
  3. a statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material; and
  4. your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Alluka may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.

6. What Happens After a Counter-Notification

When we receive a valid counter-notification, we will promptly provide a copy to the person who submitted the original notice and inform them that we will restore the removed material, or stop disabling access to it, in 10 business days. We will restore the material no less than 10 and no more than 14 business days after receiving the counter-notification, unless our designated agent first receives notice from the original complainant that they have filed an action seeking a court order to restrain the alleged infringement.

Please note that your counter-notification, including your contact information, will be shared with the original complainant.

7. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Alluka has adopted a policy of terminating, in appropriate circumstances, the accounts or access of users who are repeat infringers. We may, at our discretion, restrict or remove the ability of any user to submit content, terminate their account, or block their access to the Website if they are the subject of repeated valid infringement notices, or if we otherwise determine that they have repeatedly infringed the copyrights of others. We may also take these steps for a single instance of clear or willful infringement.

8. Misrepresentations

Please be careful when submitting a notice or counter-notification. Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner or its licensee, or the service provider as a result of the misrepresentation. If you are unsure whether material infringes your copyright, we recommend that you consult a qualified attorney before sending a notice.

9. General Terms

This Policy does not create any rights in favor of third parties and does not limit any rights or defenses available to Alluka under the DMCA or other law. We may remove content from the Website at any time and for any reason, including content that we believe may infringe the rights of others, whether or not we have received a formal notice. Nothing in this Policy is legal advice. We may update this Policy from time to time, and changes take effect when posted on this page with a revised “Last updated” date. For other rules on using the Website, see our Terms & Conditions.
